There has been a ban in the US on any candy with non-food items embedded in them for a long time (almost 80 years). The candy in question has a hard plastic egg inside the chocolate and a small toy inside that egg. Apparently, the inner egg can open while eating the candy meaning the small toy becomes a hazard if accidentally injested.
A version of a candy similar to the Kinder Egg is available for sale in the US. It's call a Choco Treasure. The main difference is that the internal capsule that holds the toy was found to be suitably sealed in a way that made it impossible for someone eating the candy to injest pieces of the toy. The Choco Treasure is also larger and contains larger toys that are not considered of the size that are a choking hazard for children.

I googled Kinder Surprise eggs and read basically exactly what Joe said about the ban, the Choco Treasures, all of it.
